Number: 06016553, with its registered office at Vinohradská 2828/151, Žižkov, 130 00 Prague 3, registered with the Commercial Register kept by the Municipal Court in Prague under file no. No. C 274160 (hereinafter also "we" or "us") and we may process personal data about users ("you") of our web application which is available at https://www.kroscloud.com (hereinafter also the "Application").

During usage of our Application or when you visit our website, we may process some personal data about you. By this Privacy Policy (hereinafter the "Policy"), we would like to inform you about how we process your personal data, what information we collect, for what period of time we process them, what rights you have in relation to the collected information and how you should exercise them.

Processing of personal data is regulated by Regulation (EU) 2016/6679 of the European parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (mostly known as "GDPR").

  1. WHAT INFORMATION WE COLLECT AND HOW WE COLLECT THEM

    When you want to use our Application, we will collect:

    Information you provide to us when creating user account in the Application. User account can be created by filling out the appropriate form on our website, or via third-party website accounts such as Facebook, Google or Microsoft. When filling form on our website, we will collect your e-mail, name of your user account, your name, surname and other billing information. You may also upload your profile picture which may also include your personal data.

    When you create your account via third-party website accounts be aware that you may share some personal data from those third-party providers. We receive from these third-party providers your specific identifier, e-mail and name of your account. However, we will always process only necessary information for creating user account (which is identifier of your account and your e-mail address, name of your account may be changed by you during registration process).

    Information we obtain when you use elements of the Application. We collect information about your user account name, and you may also insert your name and surname when you decide to publish interactive 3D presentations. If you decide, you can also enter various different personal data. We can’t influence what data you will fill, so it is your free decision to fill them. However, if you do fill them, we will also process those personal data.

    When you are browsing our website:

    Information on your activity on our website. When you visit our website, your activity on the site is recorded. We use the cookies technology to analyse the traffic on our website. When you visit our website, we collect information on your behaviour on the website. Further information on the use of cookies is given in Schedule A to this Policy.

  2. HOW WE USE THE COLLECTED INFORMATION AND ON WHAT LEGAL BASIS

    We use collected information for these purposes:

    Information you provide to us when creating user account in the Application will be processed for the purpose of creating account and personal data are necessary for the performance of a contract to which you are the party. This is also our legal basis for processing according to the Article 6, paragraph 1, letter b) of the GDPR. We will only use the data to provide you services, allow you to use all elements of the Application, provide you appropriate support and to fulfil our duties arising from the mutual relationship. We may also use your billing and other information for the purpose of fulfilment of our legal obligations, like accounting and tax obligations. Information will be processed according to the Article 6, paragraph 1, letter c) of the GDPR, i.e., compliance with a legal obligation to which we are subject. We may also use your information in order to protect our own claims and in possible further proceedings under our legitimate interest according to the Article 6, paragraph 1, letter f) of the GDPR.

    Your e-mail address will be also used for the purposes of direct marketing. In other words, we will send you newsletters, but only if you do not refuse such sending during creation of user account. We may do it under our legitimate interest according to the Article 6, paragraph 1, letter f) of the GDPR which consists of direct marketing. You may refuse sending of newsletters at any time by contacting us by e-mail on adminkroscloud.com or by clicking on URL address which is included in every newsletter we send you.

    Information we obtain when you use elements of the Application are also processed only for the purpose of fulfilment of our duties arising from the mutual relationship under the Article 6, paragraph 1, letter b) of the GDPR.

  3. FOR WHAT PERIOD OF TIME WE PROCESS THE COLLECTED INFORMATION

    Your personal data are always used only for a period necessary to achieve the purpose for which they were collected. We will only process your personal data for the period of existence of you user account in the Application. When you decide to delete your user account, we will delete all of your personal data and we also delete you from our newsletter list

    Your e-mail address is therefore processed for the purpose of direct marketing only for the duration of the user account.

  4. WHO HAS ACCESS TO INFORMATION

    We take care of the protection of personal data and we never sell your personal data. We also try not to share your data with anybody. We use our own servers to store your personal data. However, in some cases when there is issue with our Application, we may temporarily store your personal data on a backup server provided by Microsoft to prevent loss of your data.

    We process your personal data only on the territory of the European Union or the European Economic Area.

  5. WHAT RIGHTS YOU HAVE IN RELATION TO THE COLLECTED INFORMATION AND HOW YOU SHOULD EXERCISE THEM

    You have the following rights in relation to our processing of your personal data:

    a) right of access to personal data;

    b) right to rectification;

    c) right to erasure (‘right to be forgotten’);

    d) right to restriction of data processing;

    e) right to object to processing;

    f) right to data portability; and

    g) right to file a complaint with respect to personal data processing.

    The right of access means that you can ask us at any time to confirm whether or not personal data concerning you are being processed and, if they are, you have the right to access the data and to information for what purposes, to what extent and to whom they are disclosed, for how long we will process them, whether you have the right to rectification, erasure, restriction of processing or to object; from which source we obtained the personal data, and whether automated decision-making, including any profiling, occurs on the basis of processing of your personal data.

    The right to rectification means that you may request us at any time to rectify or supplement your personal data if they are inaccurate or incomplete.

    The right to erasure means that we must erase your personal data if (i) they are no longer necessary for the purposes for which they were collected or otherwise processed; (ii) the processing is unlawful; (iii) you object to the processing and there exist no overriding legitimate grounds for processing; or (iv) this is required of us based on a legal duty.

    The right to restriction of processing means that until we resolve any disputes regarding the processing of your personal data, we may not process your personal data by other way than by storing it and, where appropriate, using it only with your consent or for the purpose of determining, enforcing or defending our legal claims.

    The right to object means that you may object to the processing of your personal data that we process for reasons of legitimate interest, including profiling based on our legitimate interest. If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes. In the event of an objection to processing based on other reasons, this objection will be evaluated, and we will then inform you whether we have complied with it and will no longer process your data, or that the objection was not justified, and processing will continue. In any case, processing will be limited until the objection is resolved.

    The right to data portability means that you have the right to obtain personal data that concern you and which you have provided to us and which are processed in an automated manner and on the basis of consent or contract, in a structured, commonly used and machine-readable format, and the right to have these personal data transferred directly to another controller.

CHANGE OF THIS POLICY

Our Policy may change from time to time. The current version of the Policy can be found at https://www.kroscloud.com/privacy-policy. If there are significant changes to the Policy, we will inform you in more detail (we may notify changes to the Policy by e-mail or directly in the Application). We archive previous versions of this Policy for you to access in the future. These versions are available upon your request.
